A coastal shipping company found themselves in a tight situation when a piece of valued cargo was damaged. With our help the situation was cleared up quickly and without stress.
THE CHALLENGE
Peter ran a coastal shipping company in FNQ that was carrying a valued cargo that got damaged due to an oversight by their forklift driver. Unfortunately, the cargo owner had not taken out transit cargo insurance, a mistake of their staff. In this instance, although there was no cargo insurance for the goods shipped, as the loss was caused due to negligence of the carrier’s employee, which triggered liability under the law of torts, we presented this claim to the shipping company’s liability insurer under their Logistics Operator’s liability policy that was indemnified in full.
THE FIX
Fortunately we advised Peter early in our relationship to take out this specialist insurance to mitigate the risk of this event.
The cargo owner was happy as he got compensated for his cargo loss albeit he had no cargo insurance; the shipping company was happy as they were able to answer to the claim which was due to the negligence of their employee helping them with customer retention.
